This page explains the general terms and conditions. These terms outline the rights and obligations of both the client and the photographer, and are intended to prevent legal disputes

  1. Definitions 1.1. Client: the natural or legal person who has commissioned the assignment. 1.2. Photographer: the person who carries out the photography assignment.
  2. Applicability 2.1. These general terms and conditions apply to all legal relationships between the photographer and the client, including quotations, order confirmations, and verbal or written agreements. 2.2. Deviations from these conditions are only binding if agreed upon in writing.
  3. Quotations 3.1. Quotations are non-binding unless explicitly stated otherwise. 3.2. The photographer cannot be held to a quotation if the client can reasonably understand that the quotation contains a mistake or error.
  4. Execution of the assignment 4.1. The photographer will carry out the assignment to the best of their knowledge and ability. 4.2. The client shall ensure that all information indicated by the photographer as necessary, or which the client should reasonably understand to be necessary for the execution of the agreement, is provided to the photographer in a timely manner.
  5. Delivery 5.1. Delivery of the photos will take place within the agreed timeframe, which is always stated in the quotation. The timeframe depends on the size of the assignment. Exceeding the delivery time does not entitle the client to compensation, due to the possibility of unforeseen circumstances beyond the photographer’s control. In case of delay, a reasonable solution can of course be discussed with the photographer. 5.2. The photos will be delivered as digital copies via an online transfer program.
  6. Changes and corrections 6.1. Any desired changes or corrections to the photos must be reported within 14 days after delivery. 6.2. Without an additional work agreement, the photographer will correct no more than 5% of the total number of photos. Corrections are limited to minor adjustments such as exposure corrections, color corrections, and removal of small imperfections. Large-scale adjustments are not included in these corrections and require an additional work agreement. 6.3. The photographer will only implement requested changes if they fall within the scope of the original assignment.
  7. Copyright 7.1. The copyright of the photos rests with the photographer. 7.2. Without written permission from the photographer, it is not permitted to reproduce or edit the photos. Publication of the photos via social media or otherwise is possible in consultation and with the photographer’s permission. 7.3. If the client wishes to obtain exclusive rights to the photos, this must be agreed upon in writing in advance and additional costs will be charged.
  8. Use of images 8.1. The client grants the photographer the right to use the photos taken for promotional purposes, such as portfolios, social media, and publications, unless otherwise agreed in writing.
  9. Payment 9.1. Payment must be made within 14 days of the invoice date. 9.2. If the payment term is exceeded, the client is legally in default and owes interest equal to the statutory rate.
  10. Cancellation 10.1. If the client cancels the assignment, a cancellation fee is due. 10.2. In case of cancellation within 48 hours before the start of the assignment, the client owes 50% of the agreed amount. 10.3. In case of cancellation within 24 hours, the client owes 100% of the agreed amount. 10.4. Cancellation includes all situations in which the assignment cannot proceed, regardless of the cause, including but not limited to unforeseen circumstances such as technical defects, a vehicle dropping out of the race, or other force majeure situations.
  11. Effort and result obligations 11.1. The photographer will carry out the assignment to the best of their knowledge and ability, which constitutes an obligation of effort. The photographer cannot guarantee that a specific result will be achieved, unless otherwise agreed in writing. An example of a written result obligation is a specified number of photos to be delivered. 11.2. For specific assignments where a result obligation has been agreed, the photographer will make every effort to achieve the agreed result. If the desired result cannot be achieved due to circumstances beyond the photographer’s control, the photographer will consult with the client to find a suitable solution.
  12. Liability 12.1. The photographer is not liable for any damage, direct or indirect, arising from or related to the execution of the agreement, unless there is intent or gross negligence on the part of the photographer. 12.2. The photographer’s liability is in any case limited to the amount paid out by the photographer’s insurer.
  13. Safety and access 13.1. The photographer will comply with all safety regulations and guidelines of the event. 13.2. The client is responsible, if applicable, for providing the correct access rights and permits for the photographer at the event location. 13.3. The photographer will make initial contact with the circuit to request media accreditation for track and race days. 13.4. If access to the event requires an expected or unexpected fee for the photographer, the client will be responsible for covering these costs.
  14. Equipment 14.1. The photographer will provide the necessary equipment to carry out the assignment. In case of technical problems with the equipment, the photographer will make reasonable efforts to still carry out the assignment or offer a solution, such as returning to another event without charging additional costs to the client.
  15. Damage to vehicles 15.1. The photographer is not liable for damage to vehicles or property unless such damage is directly caused by intentional or negligent behavior of the photographer. 15.2. The client shall ensure that the vehicles being photographed are in good condition and free of defects that could pose a danger.
  16. Other provisions 16.1. All legal relationships between the photographer and the client are governed by Dutch law. 16.2. Disputes will be submitted to the competent court in the district where the photographer is established. 16.3 In case of discrepancies between the Dutch and English version of these terms, the Dutch version shall prevail.

Op deze pagina worden de algemene voorwaarden toegelicht. Deze voorwaarden beschrijven de rechten en plichten van zowel de opdrachtgever als de fotograaf en zijn bedoeld om juridische geschillen te voorkomen.

  1. Definities 1.1. Opdrachtgever: de natuurlijke of rechtspersoon die de opdracht heeft gegeven. 1.2. Fotograaf: de persoon die de fotografieopdracht uitvoert.
  2. Toepasselijkheid 2.1. Deze algemene voorwaarden zijn van toepassing op alle rechtsbetrekkingen tussen de fotograaf en de opdrachtgever, inclusief offertes, opdrachtbevestigingen en mondelinge of schriftelijke overeenkomsten. 2.2. Afwijkingen van deze voorwaarden zijn alleen bindend als deze schriftelijk zijn overeengekomen.
  3. Offertes 3.1. Offertes zijn vrijblijvend, tenzij uitdrukkelijk anders vermeld. 3.2. De fotograaf kan niet aan zijn offerte worden gehouden indien de opdrachtgever redelijkerwijs kan begrijpen dat de offerte een vergissing of verschrijving bevat.
  4. Uitvoering van de opdracht 4.1. De fotograaf zal de opdracht naar beste inzicht en vermogen uitvoeren. 4.2. De opdrachtgever zorgt ervoor dat alle gegevens, waarvan de fotograaf aangeeft dat deze noodzakelijk zijn of waarvan de opdrachtgever redelijkerwijs behoort te begrijpen dat deze noodzakelijk zijn voor het uitvoeren van de overeenkomst, tijdig aan de fotograaf worden verstrekt.
  5. Levering 5.1. Levering van de foto’s geschiedt binnen de overeengekomen termijn, welke altijd op de offerte wordt vermeld. Het termijn is afhankelijk van de opdrachtgrootte. Overschrijding van de levertijd geeft de opdrachtgever geen recht op schadevergoeding, vanwege het feit dat er onvoorziene omstandigheden kunnen plaatsvinden waar de fotograaf geen invloed op heeft. Bij overschrijding van de levertijd kan uiteraard redelijkerwijs met de fotograaf een oplossing worden gezocht. 5.2. De foto’s worden als digitale kopieën geleverd met een online transferprogramma.
  6. Wijzigingen en correcties 6.1. Eventuele gewenste wijzigingen of correcties aan de foto’s dienen binnen 14 dagen na levering te worden gemeld. 6.2. De fotograaf zal zonder meerwerkopdracht niet meer dan 5% van het aantal foto’s corrigeren. De correcties beperken zich tot kleine aanpassingen zoals belichtingscorrecties, kleurcorrecties, en het verwijderen van kleine onvolkomenheden. Grootschalige aanpassingen zijn niet inbegrepen in deze correcties en vereisen een meerwerkopdracht. 6.3 De fotograaf zal alleen gewenste wijzigingen doorvoeren als deze binnen de oorspronkelijke opdracht vallen.
  7. Auteursrecht 7.1. Het auteursrecht op de foto’s berust bij de fotograaf. 7.2. Zonder schriftelijke toestemming van de fotograaf is het niet toegestaan de foto’s te verveelvoudigen of te bewerken. Openbaarmaking van de foto’s middels sociale media of anderszins is in overleg mogelijk in afstemming en met toestemming van de fotograaf. 7.3 Indien de opdrachtgever exclusieve rechten op de foto’s wenst, dient dit vooraf schriftelijk te worden overeengekomen en worden er extra kosten in rekening gebracht.
  8. Gebruik van beelden 8.1. De opdrachtgever verleent de fotograaf het recht om de gemaakte foto’s te gebruiken voor promotionele doeleinden, zoals portfolio’s, sociale media en publicaties, tenzij anders schriftelijk overeengekomen.
  9. Betaling 9.1. Betaling dient te geschieden binnen 14 dagen na factuurdatum. 9.2. Bij overschrijding van de betalingstermijn is de opdrachtgever van rechtswege in verzuim en is hij een vertragingsrente verschuldigd gelijk aan de wettelijke rente.
  10. Annulering 10.1. Indien de opdrachtgever de opdracht annuleert is hij een annuleringsvergoeding verschuldigd. 10.2. Bij annulering binnen 48 uur voor aanvang van de opdracht is de opdrachtgever 50% van het overeengekomen bedrag verschuldigd. 10.3 Bij annulering binnen 24 uur is de opdrachtgever 100% van het overeengekomen bedrag verschuldigd. 10.4 Onder annulering vallen alle situaties waarin de opdracht niet kan doorgaan, ongeacht de oorzaak, waaronder maar niet beperkt tot onvoorziene omstandigheden zoals technische mankementen, het uitvallen van een voertuig uit de race of andere overmachtssituaties.
  11. Inspannings- en resultaatsverplichtingen 11.1. De fotograaf zal de opdracht naar beste inzicht en vermogen uitvoeren, waarbij sprake is van een inspanningsverplichting. De fotograaf kan niet garanderen dat een specifiek resultaat wordt bereikt, tenzij schriftelijk anders is overeengekomen. Een voorbeeld van een schriftelijk overeengekomen resultaatsverplichting voor de fotograaf is een te leveren fotoaantal. 11.2. Voor specifieke opdrachten waarbij een resultaatsverplichting is overeengekomen, zal de fotograaf zich inspannen om het afgesproken resultaat te behalen. Indien het gewenste resultaat door omstandigheden buiten de controle van de fotograaf niet kan worden bereikt, zal de fotograaf in overleg met de opdrachtgever naar een passende oplossing zoeken.
  12. Aansprakelijkheid 12.1. De fotograaf is niet aansprakelijk voor enige schade, direct of indirect, voortvloeiend uit of verband houdend met de uitvoering van de overeenkomst, tenzij er sprake is van opzet of grove schuld van de fotograaf. 12.2. De aansprakelijkheid van de fotograaf is in ieder geval beperkt tot het bedrag dat door de verzekeraar van de fotograaf wordt uitgekeerd.
  13. Veiligheid en toegang 13.1. De fotograaf zal zich houden aan alle veiligheidsvoorschriften en -richtlijnen van het evenement. 13.2. De opdrachtgever zorgt indien van toepassing voor de juiste toegangsrechten en vergunningen voor de fotograaf op het terrein van het evenement. 13.3 De fotograaf zal het eerste contact opnemen met het circuit om media-accreditatie aan te vragen bij track- en racedagen. 13.4 Indien voor toegang tot het evenement een verwacht of onverwachte vergoeding vereist is voor de fotograaf, zal de opdrachtgever verantwoordelijk zijn voor het voldoen van deze kosten.
  14. Apparatuur 14.1. De fotograaf zorgt voor de benodigde apparatuur om de opdracht uit te voeren. In geval van technische problemen met de apparatuur zal de fotograaf redelijke inspanningen verrichten om de opdracht toch uit te voeren of een oplossing bieden zoals het terugkeren bij een ander evenement zonder extra kosten in rekening te brengen bij de opdrachtgever.
  15. Schade aan voertuigen 15.1. De fotograaf is niet aansprakelijk voor schade aan voertuigen of eigendommen, tenzij deze schade rechtstreeks te wijten is aan opzettelijk of nalatig gedrag van de fotograaf. 15.2. De opdrachtgever zorgt ervoor dat de voertuigen die gefotografeerd worden in goede staat verkeren en vrij zijn van defecten die gevaar kunnen opleveren.
  16. Overige bepalingen 16.1. Op alle rechtsbetrekkingen tussen de fotograaf en de opdrachtgever is Nederlands recht van toepassing. 16.2. Geschillen zullen worden voorgelegd aan de bevoegde rechter in het arrondissement waar de fotograaf is gevestigd. 16.3 In geval van tegenstrijdigheden tussen de Nederlandse en Engelse versie van deze voorwaarden, prevaleert de Nederlandse versie.
